Defensible space and fire mitigation in Incline Village, NV

Defensible space in Incline Village means working inside two sets of rules: the Living With Fire zones around the house, and the Tahoe Regional Planning Agency limit on cutting live trees over 14 inches in diameter. Battle Born Tree Service does the pruning, thinning, needle and brush removal once you know what the North Lake Tahoe Fire Protection District will allow.

The USDA Forest Service puts 61% of Incline Village's buildings in the direct wildfire exposure zone, meaning forest stands close enough to carry flame to the walls. Here the fuel is not sagebrush. It is conifers, their needles and the shrubs under them.

Who decides which trees can come out?

Not us, and not you alone. In the Lake Tahoe Basin a live tree over 14 inches in diameter at breast height needs a permit before it is removed. The Tahoe Regional Planning Agency says removal for defensible space can be permitted by the local fire protection agency, which for Incline Village is the North Lake Tahoe Fire Protection District. The district evaluates the property and marks what may be cut.

So the order matters: evaluation first, then our estimate against the marked trees. A dead tree that could fall on a house needs no TRPA permit. The measuring method is in our guide to Tahoe tree removal permits and DBH. The agency decides.

Limbing up has a limit at Tahoe

Removing the low branches that let a ground fire climb into a crown is standard defensible space work. At Tahoe there is a ceiling on it. TRPA requires a permit to remove branches from the upper two-thirds of a tree, with exceptions for limbs near structures, utility conflicts and dead wood.

In practice that leaves the lower third for limbing up, plus any dead wood at any height and limbs that touch or overhang the roof. Our arborist sets the cut heights tree by tree.

Pine needles are the yearly job

The Living With Fire guide is specific about needles in pine country. In Zone 0, the first 5 feet, there should be none. In Zone 1, from 5 to 30 feet, it says to remove all pine needles once in the spring. In Zone 2, out to 100 feet, needles should not build up deeper than 3 inches.

A crew with a chipper and a dump truck can clear a season of needles, cones and fallen limbs from a lot in one visit and haul it away, along with the dead shrubs and small trees that come out.

Condos, associations and shared ground

Only about 58% of Incline Village's housing units are single-family detached houses (American Community Survey 2020 to 2024). The rest are condominiums, townhomes and other attached buildings, where the trees usually stand on common area. That work is ordered by the association or its manager, and one evaluation and one plan can cover a whole complex. See HOAs and property managers.

About 47% of the homes date from before 1980, so many of the trees closest to roofs and decks are full grown.

The fire record around Incline

Eight perimeter records of 300 acres or more since 1980 have centers mapped within about 10 miles. They include the Martis Fire of 2001 at 14,429 acres, the Little Valley Fire of 2016 at 2,292 acres, the Royal Fire of 2003 at 339 acres with its center about 4 miles away, and the Davis Fire of 2024 at 5,824 acres. Overall the Forest Service rates risk to homes here higher than 97.7% of US communities.

TRPA permit: live trees over 14 inches in diameter at breast height (over 6 inches on lakeshore lots, between the house and the lake). Branch removal in the upper two-thirds of a tree also needs a permit, with exceptions.

Measuring aid

Tahoe tree permit check: measure your tree

In the Lake Tahoe Basin, the Tahoe Regional Planning Agency (TRPA) requires a permit to remove a live tree over 14 inches in diameter at breast height (4.5 feet up the trunk). On lakeshore lots the limit is 6 inches for trees between the house and the lake. Wrap a tape around the trunk at 4.5 feet and enter the number.

Enter the measurement to see the diameter.

This is a measuring aid, not a ruling. TRPA and your fire protection district decide. A dead tree that could fall on a house does not need a TRPA permit. TRPA tree rules

Living With Fire zones

The three defensible space zones

0-5 ft5-30 ft30-100 ft
  1. Zone 0: 0 to 5 feet. Ember-resistant zone. Nothing that burns against the house: clear dead leaves and needles, move firewood away, cut back branches that touch walls or hang over the roof.
  2. Zone 1: 5 to 30 feet. Lean, clean and green. Remove dead plants and ladder fuels, limb up trees, and break up continuous shrubs such as junipers.
  3. Zone 2: 30 to 100 feet. Reduced fuel. Thin crowded trees and brush so fire stays on the ground and slows down. This is where the brush mower and masticator work.

Defensible space and fire mitigation questions in Incline Village

Still have a question? Call 775.232.8243. Phones are answered seven days a week.

Can I cut down a big pine for defensible space in Incline Village?

Only with a permit if it is alive and over 14 inches in diameter at 4.5 feet. The North Lake Tahoe Fire Protection District evaluates properties and issues defensible space tree permits. We remove what has been approved.

Do you haul away pine needles?

Yes. Needles, cones, limbs and brush from the job are chipped or loaded and removed. Tell the estimator if you want any chips left.

Is small-tree thinning covered by the 14-inch rule?

The TRPA permit rule applies to live trees over 14 inches in diameter, or over 6 inches between the house and the lake on a lakeshore lot. Smaller trees fall below that line, but ask the fire district during your evaluation before thinning.

Do you work for Incline Village homeowner associations?

Yes. We work for homes, HOAs and commercial sites, and one plan can cover the common area of a whole complex.
