## 1. Who we are and what this Policy covers

Operator. The Site is operated by Battle Born Tree Service LLC, a tree service company whose office and yard are at 6301 US Highway 50 East, Carson City, NV 89701. We provide tree removal, crane-assisted tree removal, tree trimming and pruning, stump grinding, emergency tree service and storm clean-up, defensible space and fire mitigation, lot clearing, brush mowing, snow and ice removal, and firewood and wood chips, for homes and businesses in Northern Nevada.

Scope. This Policy applies to personal information we collect through the Site, including its forms, the "before you go" panel, our website chat assistant and the emails the Site sends and receives on our behalf, and to other communications that refer to this Policy.

What this Policy does not cover. This Policy does not govern the practices of third parties we do not control, such as Google, review platforms, social networks, government agencies, utilities or other websites we link to, even if you reach them from the Site. Information you give us by telephone or at your property, and information in an estimate or work agreement, is handled in the ordinary course of our business and is also covered by the sections of this Policy that describe how we use, share, keep and protect information. If an agreement you sign with us contains privacy terms that differ from this Policy, the agreement controls for that job.

How the Site works. The Site is built and managed for us by our website provider, YelloPost, and is hosted on servers in the United States. The Site does not offer user accounts or logins, does not accept online payments, does not book appointments and does not sell anything online. Its purpose is to provide information about our services, trees, fire safety and our service area, and to let you ask us for a free estimate.

## 2. Definitions

In this Policy, the following terms have the meanings below.

- "Site" means battleborntreeservice.com, including the plain-text versions of its pages (the index.md files), its llms.txt summary files, the data tables it offers for download, and any other page that links to this Policy.
- "Personal information" means information that identifies, relates to, describes or can reasonably be linked, directly or indirectly, to a particular individual or household, such as a name, telephone number, email address, property address or the content of a message. It includes "covered information" as defined in NRS 603A.320 to the extent that definition applies.
- "Request" means any free estimate form, contact form or "before you go" panel submission, any chat conversation in which you give your contact details, and any email you send us, through which you ask us a question, ask for an estimate or ask us to contact you.
- "Service provider" means a company that processes personal information on our behalf to help us operate the Site and our business, and that is not permitted to use it for its own unrelated purposes.
- "Browser storage" means small pieces of information that the Site saves in your web browser using the browser's local storage or session storage features. It is similar in purpose to a cookie but is not sent to our servers with each page request.
- "Cookie" means a small text file placed in your browser by a website or by a third-party service loaded on a website.

## 3. Summary of our practices

This summary highlights key points. It is not a substitute for the full Policy, which controls.

- We collect the information you choose to send us when you ask for an estimate or ask a question, including any photos you attach, plus limited technical information from your browser.
- We use it to answer you, prepare and schedule an estimate, perform and document work, keep business records, protect the Site from spam and abuse, and understand how people use the Site.
- Messages you type into our website chat assistant are processed by automated technology (YelloPost AI) to generate replies. The chat assistant is an automated program, not a person.
- Google Tag Manager and the Google measurement tools it loads run on the Site unless you choose "Essential only" in our privacy choices box, which you can do at any time, or your browser sends a Global Privacy Control signal.
- Our forms are protected by Cloudflare Turnstile, a human-verification check that receives your IP address and browser information.
- We do not sell personal information, and we do not share it with other companies for their own marketing.
- We share information with service providers who help us run the Site and our business, and when the law requires it.
- Anyone may ask us to see, correct or delete the personal information we hold about them. Nevada residents have the rights described in Sections 18 and 19.

## 4. Information you provide to us

Most of the personal information we have comes directly from you. What we collect depends on how you contact us and what you choose to share.

Estimate and contact forms. Our forms ask for your name, telephone number and email address, the property address or town, the service you need, how you found us and a description of the tree or the job. If you sent the form from a page about a particular service or town, the name of that page may be included. When you send a form, the Site also sends the address of the page you sent it from, so that we know what you were looking at.

Photos. Our forms let you attach up to five photos of the tree or the job. Photos are optional. Your browser reduces their size before sending, and the photos are attached to the email that delivers your Request to us. Photos can show your property and anything else in the picture, so please send only what you are comfortable sharing, and avoid photos that show people.

Before-you-go panel. On desktop computers, some pages may show a short panel inviting you to ask for a free estimate when your pointer leaves the top of the browser window. If you use it, it collects the information you enter, such as your name, a telephone number or email address, the service you need and your town. You can close it without providing anything.

Website chat assistant. When you use our website chat assistant, Timber, we receive the content of the conversation, including anything you type. Section 6 describes the chat in detail.

Emails. If you email us, we receive the contents of your message, your email address and anything you attach.

Calls and visits to your property. If you call us, or we visit your property to prepare an estimate or do work, we receive the information you choose to share and the information needed to prepare the estimate and perform and document the work, such as the property address, access instructions, photographs and notes about the trees and the site, and billing information. The Site does not record or track telephone calls.

Information about other people. If you give us information about another person, such as a landlord, tenant, neighbor, family member or property manager, please make sure you have their permission to do so.

Please do not send us Social Security numbers, driver's license numbers, bank account or payment card numbers, passwords, health information or other sensitive information through the Site, the chat or email. We do not need it to prepare an estimate, and the Site does not accept payments.

## 5. Information collected automatically

Server and security logs. Like virtually all websites, the servers that host the Site receive technical information that your browser sends with each request, such as your IP address, browser and device type, the page requested, the referring page and the date and time. This information is used to deliver pages, keep the Site secure, diagnose problems and prevent abuse. When you send a form or use the chat, our systems may also record your IP address together with the result of our automated spam and abuse checks (see Section 7).

Google Tag Manager and measurement tools. The Site loads Google Tag Manager, which may load Google Analytics and other Google measurement tools, unless you choose "Essential only" or your browser sends a Global Privacy Control signal. These tools use cookies and similar technologies to collect information about your visit, such as the pages you view, how you arrived, how long you stayed, approximate location derived from your IP address, device and browser information, and whether you took actions such as tapping our telephone number or our email address, opening the chat or sending a Request. Section 9 explains these tools and how to turn them off.

Browser storage. The Site uses browser storage to remember your choices and keep the Site working as you expect. Section 8 lists each use.

Third-party resources. Some parts of the Site, such as the map on our contact page and the human-verification check on our forms, are delivered by Google or Cloudflare, whose servers receive your IP address when your browser requests them. Section 10 describes them.

Interactive tools. The tree triage chips, the Lake Tahoe tree diameter checker and similar tools on the Site run in your browser. The numbers you enter in the diameter checker are not sent to us. If you choose a triage option, the Site may record that a choice was made as a measurement event (Section 9) and may pre-select the matching service in the estimate form.

## 6. Our website chat assistant

What it is. Timber is our website chat assistant, powered by YelloPost AI, an artificial-intelligence service provided through our website provider, YelloPost. It is an automated program, not a person and not an arborist. It generates replies automatically based on what you type.

How your messages are processed. The messages you type, together with the assistant's earlier replies in the same conversation and the address of the page you are on, are sent to our service provider and processed by the technology provider it uses, so that a reply can be generated. By using the chat, you consent to this processing. If you do not want your messages processed this way, please call us or use a form instead.

In your browser. The conversation is kept only in the open page. It is not saved in your browser storage, and it is cleared from your browser when you close or reload the page.

Contact details passed to our office. If you give the assistant your name and a telephone number or email address, the assistant prepares a Request containing your contact details, the service and the town or address you mention, a description of the job and a short summary of the conversation. That Request is emailed to us so that a person can follow up with you. If you gave an email address, you may also receive an automatic confirmation email.

Conversation transcripts. When you leave or close a page after sending at least one chat message, a transcript of the conversation, together with the page address, the date and time and your IP address, is emailed to the service provider that operates the Site, and may be shared with our team, so that the quality of the assistant's answers can be monitored, Requests are not missed and the chat is protected from abuse.

Abuse protection. To prevent abuse, the chat limits how many messages can be sent from one IP address in a period of time. It does this using counters linked to a coded (hashed) form of the IP address, which are kept temporarily.

What not to share. Please do not type sensitive information into the chat, such as financial account numbers, Social Security numbers or health information.

Accuracy and safety. Chat replies are general information and may be incomplete or wrong. The assistant cannot see your tree. It does not tell you whether a tree is safe, does not quote prices, does not promise a schedule and does not decide whether a permit is needed. If a tree is down, on a structure or near a power line, do not rely on the chat: call 911 if anyone is in danger, and call us at [775.232.8243](tel:775.232.8243). Our [Terms of Use](https://battleborntreeservice.com/terms/) explain this further.

## 7. Automated screening, spam and duplicate protection

Human verification. Our forms are protected by Cloudflare Turnstile, a service that checks whether a submission is likely to come from a person rather than an automated program. It usually runs in the background without asking you to do anything. To do this, Cloudflare receives your IP address and information about your browser and device, and processes it under its own privacy policy.

Screening. To protect our team and our customers, Requests sent through the Site and the chat are automatically screened for spam, abuse and unsolicited sales pitches. Screening is performed by automated rules and tools operated for us by our service provider, and some messages may be analyzed by an automated classification service to decide whether they look like a sales pitch. A message that the screening flags may be held for review by a person at our service provider before it is delivered to us. Screening is used only to decide how a message is handled. It is not used to make decisions that produce legal or similarly significant effects about you.

Duplicate protection. To avoid sending us the same Request twice, for example after a double click, the Site keeps a short record of each successful form Request, filed under a coded (hashed) value made from your email address and telephone number and containing the time and the message text. If the same person sends the same Request again within ten minutes, the second copy is not sent, and a log line noting the skipped duplicate (including the email address or telephone number and the time) is written. The chat keeps a similar coded marker so that one chat Request is emailed only once. These records are kept on the server outside the public website.

Delivery log. Our service provider keeps a log that records only the time, the website and whether a Request came from a form or the chat, so that it can confirm Requests are being delivered. It does not contain your name or contact details.

If your Request is held. If you sent a genuine Request and have not heard back, please call us at [775.232.8243](tel:775.232.8243). Our phones are answered seven days a week.

## 8. Browser storage and cookies we use

The Site itself does not use browser storage to track you across other websites. It uses browser storage only for the following purposes, which are necessary for the Site to work as you expect or to remember choices you have made:

- Local storage (bbt_cc): your privacy choice ("Accept all" or "Essential only"), so that the privacy choices box does not reappear on every page.
- Local storage (bbt-a11y-v3): your accessibility menu settings, such as text size or contrast, if you use the accessibility menu.
- Local storage (bbt_hide_a11y and bbt_hide_chat): whether you closed the accessibility button or the chat button, so that it stays closed until you restore it.
- Session storage (bbt_sent and bbt_chat_lead): whether you have already sent a Request or given your contact details in the chat during this visit, so that we do not count or ask for it twice and do not show you the before-you-go panel afterward.
- Session storage (bbt_exit): whether the before-you-go panel has already been shown during this visit, so that it appears at most once.

Information in local storage stays in your browser until you clear it. Session storage is cleared when you close the browser tab. You can clear browser storage and cookies at any time through your browser settings. If you do, the Site will treat you as a new visitor, show the privacy choices box again and forget your accessibility settings.

Cookies placed by Google Tag Manager and the tools it loads, any cookies Google sets through the embedded map, and any cookies Cloudflare uses for the human-verification check are placed by those companies, not by the Site itself. They are described in Sections 9 and 10.

## 9. Analytics, measurement and your privacy choices

The privacy choices box. On your first visit, a box titled "Your privacy" appears after you begin to scroll. It explains that we use cookies to run the Site and to see which pages help people, and it offers two choices: "Accept all" and "Essential only." You can reopen it at any time with the "Privacy choices" button in the footer of every page.

How analytics load. Unless you have chosen "Essential only" or your browser sends a Global Privacy Control signal, the Site loads Google Tag Manager shortly after the page loads or as soon as you interact with the page, whether or not you have made a choice in the box. Google Tag Manager manages the loading of other measurement tags. Through it, the Site may load Google Analytics (GA4), which helps us understand how visitors use the Site, and Google advertising measurement tags, which help us understand whether our online advertising leads to calls and Requests. These tools set cookies and collect information about your visit and actions on the Site, which Google processes. Google may combine that information with other information it holds about you, such as information associated with your Google account, according to Google's own policies and your Google settings.

Essential only. If you choose "Essential only," the Site does not load Google Tag Manager on that and later pages. If the tools were already running on the page, the page reloads without them. Your choice is remembered in browser storage (Section 8) until you change it or clear your browser storage. The Site continues to work, including the forms, the chat and the map. Cookies that Google set before you made the choice stay in your browser until they expire or you delete them.

Global Privacy Control. If your browser sends a Global Privacy Control (GPC) signal, the Site treats it as an "Essential only" choice: Google Tag Manager is not loaded, whatever is stored in the privacy choices box. See Section 23.

Tracking over time and across websites. Unless you choose "Essential only" or send a GPC signal, Google may collect information about your online activities over time and across different websites, including the Site. Google also receives your IP address when your browser loads the embedded map, and Cloudflare receives it when the human-verification check runs (Section 10), whatever you choose in the privacy choices box.

Google's controls. You can learn about Google's practices and choices at policies.google.com and control ad personalization in your Google account settings. Google also offers a browser add-on for opting out of Google Analytics.

Browser-level controls. Most browsers let you block or delete cookies and browser storage, and some offer built-in tracking protection. Blocking all storage may cause parts of the Site, such as remembering your privacy choice, to stop working.

## 10. Third-party resources that receive your IP address

Some content on the Site is loaded from third-party servers. When your browser requests it, the third party receives your IP address and standard technical information from your browser, and processes it under its own privacy policy. These resources are:

- Google Maps, which provides the embedded map on our contact page. The map is set to load when that part of the page is about to come into view. Google may set or read cookies through an embedded map under its own policies. Our address is also shown as text on the Site.
- Google Tag Manager and the Google measurement tools it loads, unless you choose "Essential only" or send a GPC signal (Section 9).
- Cloudflare Turnstile, which runs the human-verification check on our forms (Section 7), and Cloudflare, which provides domain name (DNS) and security services for the Site.
- Web fonts. The typefaces used on the Site are served from our own server where possible. If a typeface is loaded from a font service, that service receives your IP address when your browser requests the font.

The Site also links to other websites, such as Google Maps directions, our Google, Facebook, Yelp, Nextdoor and Better Business Bureau profiles, the Tahoe Regional Planning Agency, NV Energy, fire protection districts and other government and public-data websites. Those websites receive information from your browser only if you click a link and visit them. See Section 26.

## 11. How we use personal information

We use personal information for the following purposes:

- Responding to Requests. To answer your questions, call or email you back, and understand the tree or the job you are asking about, including by reviewing your form, your photos and your chat conversation.
- Estimates and services. To prepare and deliver estimates, schedule and perform tree work, fire mitigation, snow removal and our other services, and document conditions and the work performed.
- Confirmations and service communications. To send you an automatic confirmation of your Request if you gave us an email address, and to communicate with you about your estimate, scheduling, your job and billing.
- Quality and delivery monitoring. To confirm that Requests from the Site reach us, that the forms and chat work properly and that the chat's answers are accurate and helpful.
- Measurement and improvement. To understand which pages, topics and advertisements lead people to contact us, and to improve the Site, our content, our advertising and our customer service.
- Security and abuse prevention. To protect the Site, our forms, our chat, our team and our customers against spam, fraud, unsolicited sales pitches and other abuse.
- Legal and business purposes. To keep business, tax and accounting records, comply with legal obligations, respond to lawful requests, establish or defend legal claims, enforce our [Terms of Use](https://battleborntreeservice.com/terms/), and in connection with a business transfer described in Section 12.

We do not use personal information for purposes that are materially different from those described above without telling you and, where the law requires it, asking for your consent.

## 12. How we share personal information

We do not sell personal information, and we do not share it with other companies for their own marketing. We share personal information only as described below.

Service providers. We share personal information with service providers that perform services for us and are expected to keep it confidential and use it only to provide their services to us. They include:

- Our website provider, YelloPost, which builds, hosts and manages the Site, operates our forms, the chat and the screening described in Section 7, receives copies of Request notifications and chat transcripts so that it can monitor delivery and quality, and keeps the delivery log.
- YelloPost AI and the provider of the automated language technology it uses, which process chat messages to generate replies.
- Email service providers that deliver Request notifications to us and confirmation emails to you, and the provider of our business email account, which stores the messages we receive.
- Google, for the embedded map and, unless you choose "Essential only" or send a GPC signal, Google Tag Manager and the measurement tools it loads.
- Cloudflare, for DNS, security and the Turnstile human-verification check on our forms.
- Providers of the business tools we use to keep records, schedule work and bill for it, which process information as needed to provide those services to us.

People involved in your job. We share information with a property manager, landlord, homeowners association, insurance company or adjuster when you ask us to, or when it is necessary to perform or bill for the work you requested. We may share the location of planned digging or grinding with the utility notification center (811) as the law requires. These parties use the information under their own policies and obligations.

Subcontractors and equipment operators. If we engage a subcontractor or equipment operator for part of a job at your property, we share the information needed for them to do that work.

Legal and compliance. We may disclose information when we believe in good faith that disclosure is required by law, regulation, subpoena, court order or other legal process; to respond to lawful requests from government authorities; to establish, exercise or defend legal claims; to enforce our agreements; or to protect the rights, property or safety of our customers, our team, the public or us.

Business transfers. If we are involved in a merger, acquisition, financing, reorganization, sale of all or part of our business or assets, or a similar transaction, personal information may be disclosed to the parties involved and transferred as part of the transaction, subject to this Policy or to a notice we provide.

With your direction or consent. We may share information with anyone else when you ask us to or give us permission.

Aggregated or de-identified information. We may use and share information that has been aggregated or de-identified so that it no longer reasonably identifies any individual, for example the number of Requests we receive for a type of service.

## 13. Sale of personal information and targeted advertising

We do not sell personal information for money. We do not sell "covered information" (as defined in NRS 603A.320); "sale" has the meaning given in NRS 603A.333.

Unless you choose "Essential only" or send a GPC signal, the Google measurement tools loaded through Google Tag Manager may allow Google to associate your visit and actions on the Site with our advertising and with information Google holds. Under some state laws, this kind of measurement may be treated as "sharing" for cross-context behavioral advertising or as "targeted advertising." We describe it here so that you can decide. You can turn it off at any time by choosing "Essential only" through the "Privacy choices" button in the footer, and we treat that choice, and a GPC signal, as your opt-out. Apart from these Google tools, we do not share personal information for cross-context behavioral advertising.

## 14. Emails the Site sends

Notifications to us. Every Request sent through the Site's forms, and every chat Request in which you give your contact details, generates an email to us containing the information described in Sections 4 and 6, including any photos you attached. If you gave an email address, the notification is set so that our reply comes to you.

Copies to our service provider. Our website provider receives copies of Request notifications so that it can monitor whether Requests are delivered and handled promptly and whether the forms work properly.

Confirmation to you. If you include an email address, you may receive an automatic confirmation email from Battle Born Tree Service. It is sent through our service provider's email service. Your photos are not sent back to you. If you reply to the confirmation, your reply comes to us.

No marketing lists. We do not add you to a marketing email list because you sent a Request. If we ever send marketing email, it will include a way to unsubscribe.

## 15. How long we keep personal information

We keep personal information for as long as reasonably needed for the purposes described in this Policy, and then delete it or de-identify it. In deciding how long to keep information, we consider:

- Whether you became a customer, and the time needed to perform, document and answer later questions about the work.
- Tax, accounting and other legal recordkeeping requirements.
- Whether the information is relevant to an actual or potential dispute, claim, insurance matter or legal proceeding.
- The need to protect against spam, fraud and abuse.
- Whether you have asked us to delete the information and whether we are permitted or required to keep it.

Request emails, photos and chat Requests are kept in our email account and records under these criteria. Duplicate-protection records and chat rate-limit counters are short-lived technical records used for the purposes in Sections 6 and 7. Server logs are kept for a limited period under our hosting provider's settings. Information in your browser storage stays in your browser until you clear it. Information collected by Google and Cloudflare is kept according to their retention settings and policies. Backup copies may persist for a limited time after deletion from active systems until they are overwritten in the normal course.

## 16. How we protect personal information

We use reasonable administrative, technical and physical safeguards designed to protect personal information against loss, misuse and unauthorized access, disclosure, alteration and destruction, appropriate to the nature of the information. These include:

- Encrypted connections (HTTPS) between your browser and the Site.
- Encrypted connections when the Site sends Request emails to its email service.
- Keeping duplicate-protection records and similar files outside the public part of the website.
- Access controls on the systems that hold personal information, and limiting access to people who need it.
- Requiring our service providers to keep personal information confidential.
- Human verification and automated spam and abuse screening on our forms and chat.

No method of transmitting information over the internet, and no method of electronic storage, is completely secure, and we cannot guarantee absolute security. Email in particular is not always encrypted in transit. Please keep this in mind when deciding what to send us, and call us if you prefer.

## 17. Security incidents and breach notification

If we learn of a breach of the security of a system that holds personal information about Nevada residents, we will provide notice as required by NRS 603A.220, in the most expedient time possible and without unreasonable delay, consistent with the legitimate needs of law enforcement and any measures necessary to determine the scope of the breach and restore the reasonable integrity of the system. For residents of other states, we will provide notice as required by the laws that apply. If you believe your information has been compromised through the Site or our communications, please contact us right away.

## 18. Nevada privacy notice (NRS 603A.300 to 603A.360)

This section, together with the rest of this Policy, is our notice under NRS 603A.340 to consumers who use the Site. It addresses each element required by that law.

Categories of covered information we collect. Through the Site and our online services, we collect the following categories of covered information about consumers who use or visit the Site:

- First and last name.
- Telephone number.
- Email address, if you provide one.
- Physical address of your property, or your town, if you provide it.
- Any other identifier that allows a specific person to be contacted, and information about you that is collected online and maintained in combination with those identifiers, such as the content of your Request, your photos, your chat conversation, and technical information such as IP address and device and browser information.

Categories of third parties with whom we may share covered information. We may share covered information with the categories of third parties described in Section 12: our service providers (website and hosting, email delivery, the chat assistant service, security and human verification, and, unless you choose "Essential only" or send a GPC signal, analytics and advertising measurement); property managers, landlords, homeowners associations, insurers and others involved in your job; subcontractors; government authorities, courts and others for legal and compliance purposes; and parties to a business transfer.

Reviewing and requesting changes. You may review and request changes to the covered information we have collected about you through the Site by emailing battleborntreeservice@gmail.com, by calling [775.232.8243](tel:775.232.8243) or by writing to us at the address in Section 30. Section 21 explains how we handle these requests.

How we notify you of material changes. We will notify you of material changes to this Policy by posting the updated Policy on this page with a new effective date, and, for material changes, by providing additional notice on the Site, such as a notice near the top of this page, for a reasonable period.

Collection over time and across websites. Third parties may collect covered information about your online activities over time and across different websites when you use the Site, because Google Tag Manager and the Google tools described in Section 9 load by default. If you choose "Essential only" or send a GPC signal, those tools are not loaded. See also Sections 10 and 23.

Effective date. This Policy is effective as of the date shown at the top of this page.

## 19. Your Nevada right to opt out of the sale of covered information (NRS 603A.345)

Your right. Nevada law gives consumers the right to direct an operator not to make any sale of covered information that the operator has collected or will collect about the consumer. We do not sell covered information (NRS 603A.320), as "sale" is defined in NRS 603A.333. Even so, you may submit a verified request directing us not to sell your covered information in the future, and we will honor it.

How to submit a request. Email your request to our designated address, battleborntreeservice@gmail.com, with the subject line "Nevada Do Not Sell Request." Please include your name and the telephone number or email address you used when you contacted us, so that we can locate your information and verify your request. You may also call [775.232.8243](tel:775.232.8243) and we will help you submit the request.

Our response. We will respond to a verified request within 60 days after we receive it. If reasonably necessary, we may extend that period by up to 30 additional days, and we will let you know if we do.

## 20. Consumer health data

Nevada law (Senate Bill 370 of 2023) provides protections for "consumer health data." The Site is designed to request information about trees and property, not information about anyone's health, and we do not seek consumer health data.

Sometimes visitors choose to mention health information, for example an injury from a fallen tree or a condition that makes a situation urgent. If you volunteer health information, we use it only to respond to your Request. We do not sell it, and we do not use it for advertising. It is kept with the record of your Request under the criteria in Section 15. If you would like us to delete health information you volunteered, contact us as described in Section 21.

Nothing on the Site is medical advice. If anyone is hurt, call 911.

## 21. How to make a privacy request

What you can ask. Whether or not a particular privacy law applies to us, you may ask us to tell you what personal information we hold about you, to give you a copy of it, to correct information that is inaccurate, to delete it, or to stop contacting you by a particular method. Nevada residents may also make the requests described in Sections 18 and 19.

How to ask. Email battleborntreeservice@gmail.com with the subject line "Privacy Request," call [775.232.8243](tel:775.232.8243), or write to us at the address in Section 30. Please describe your request and tell us how we can reach you.

Verification. To protect your information, we will take reasonable steps to verify your identity before acting on a request, usually by confirming details you gave us when you contacted us, such as your name, telephone number, email address or property address. We use the information you provide in a request only to verify and respond to it.

Authorized agents. You may use an authorized agent to make a request on your behalf where the law allows. We may ask the agent for proof of authorization and may ask you to verify your identity directly.

Limits. We may keep information that we are required or permitted by law to retain, such as records of work performed, invoices and information needed for legal claims, even after a deletion request, and we will explain the reason if we cannot fulfill all or part of a request.

Timing. We aim to respond to requests promptly and within the time required by applicable law.

No retaliation. We will not deny you service, charge you a different price or provide a different level of service because you exercised a privacy right.

## 22. Residents of other states

We are a local business serving Northern Nevada, and the Site is intended for people seeking our services in Nevada. Residents of other states, such as owners of Nevada property who live elsewhere, may have rights under the privacy laws of their own states, such as rights to know, access, correct or delete personal information, or to opt out of certain processing.

Some of those laws apply only to businesses that meet certain thresholds, for example based on annual revenue or the number of residents whose information is processed, and may not apply to a business of our size. To the extent a state privacy law applies to us and to your information, we will honor requests made under it. Whether or not a particular law applies, you may contact us with any privacy request using the methods in Section 21 and we will consider it in good faith.

California residents. If the California Consumer Privacy Act applies to our handling of your information, the categories of personal information we collect, the sources, the purposes and the categories of recipients are described in Sections 4 through 14 of this Policy. We do not sell personal information and do not knowingly sell or share the personal information of consumers under 16 years of age. You may exercise any applicable rights using the methods in Section 21.

## 23. Do Not Track and Global Privacy Control

Do Not Track. Some browsers can send a "Do Not Track" signal. Because there is no common industry standard for how to respond to these signals, the Site does not respond to them. The way to turn off analytics and advertising measurement on the Site is the "Essential only" choice described in Section 9, or a Global Privacy Control signal.

Global Privacy Control. The Site reads the Global Privacy Control signal. When your browser sends it, the Site does not load Google Tag Manager or the measurement tools it manages, and this takes priority over any earlier "Accept all" choice stored in that browser. The Site continues to work, including the forms, the chat and the map.

## 24. Children and minors

The Site is intended for adults and is not directed to children. We do not knowingly collect personal information from children under 13 years of age, consistent with the Children's Online Privacy Protection Act. If you are a parent or guardian and believe your child under 13 has given us personal information through the Site, contact us and we will delete it.

Individuals under 18 should not send Requests or chat with our assistant without the involvement of a parent or guardian. If a tree has fallen and anyone is in danger, tell an adult and call 911.

## 25. Your contact preferences

When you send a Request, you ask us to contact you about it. You can tell us at any time to stop contacting you, or to stop contacting you by a particular method, by replying to our email, calling us or emailing battleborntreeservice@gmail.com. Agreeing to be contacted is never a condition of buying our services.

## 26. Links, reviews and social media

The Site contains links to third-party websites and services, including Google, Facebook, Yelp, Nextdoor, the Better Business Bureau, government agencies, utilities and public-data sources. When you follow a link, the third party's own privacy policy governs what it collects. We are not responsible for the privacy practices of websites we do not operate, and we encourage you to read their policies.

Reviews. The Site shows reviews and excerpts of reviews that customers posted publicly on Google, word for word, identified by first name and last initial. If you post a review on a third-party platform, what you post is public and is governed by that platform's terms.

## 27. Automated tools

Automated technology is used on the Site in three ways: to generate replies from our website chat assistant (Section 6), to verify that form submissions come from people (Section 7) and, for some messages, to help screen out unsolicited sales pitches (Section 7). None of them is used to make decisions that produce legal or similarly significant effects about you, such as decisions about credit, housing, insurance, employment or access to our services. No automated tool on the Site assesses the condition or safety of a tree; that is done in person by a certified arborist.

## 28. Where your information is processed

We are located in Nevada, and the Site is hosted on servers in the United States. Our service providers may process information in the United States and, in some cases, in other countries where they or their subcontractors operate. The Site is intended for people in the United States. If you access it from outside the United States, your information will be transferred to and processed in the United States, where privacy laws may differ from those in your country.

## 29. Changes to this Policy

We may update this Policy from time to time to reflect changes in the Site, our business, our service providers or the law. When we do, we will post the updated Policy on this page and change the effective date at the top. If we make material changes, we will also provide a notice on the Site as described in Section 18. Changes take effect when posted, unless the notice says otherwise. Your continued use of the Site after a change takes effect means that the updated Policy applies to your use. Where the law requires it, we will ask for your consent before applying a materially less protective change to information we collected earlier.
