# Can I prune a Tahoe tree without a permit?

Sometimes. TRPA says a permit is needed to remove branches from the upper two-thirds of a tree's total height, unless the branch is within 10 feet of a chimney outlet, building or deck, rubbing on utility lines, or dead.

## The upper two-thirds rule

TRPA calls this substantial trimming. Taking branches from the upper two-thirds of the total height of the tree requires a permit. Small trimming below that line, the lower third, is not what the rule is about, though other rules can apply.

The three exceptions listed on TRPA's page are a branch within 10 feet of a chimney outlet, building or deck; a branch rubbing or pulling on utility lines within your property boundary, where TRPA says to consult the power company first; and a dead branch.

## Other triggers to know

Any manipulation of live vegetation in a stream environment zone or the backshore of Lake Tahoe needs TRPA review, trees and shrubs included. And a tree planted or retained as a condition of a permit needs a permit to remove, whatever its size.

Removal has its own thresholds. A live tree over 14 inches diameter at breast height needs a permit, and 6 inches on a lakeshore lot between house and lake. See [the 14-inch rule and how to measure DBH](https://battleborntreeservice.com/guides/tahoe-tree-removal-permits-dbh/).

## What to do before you hire

If you are unsure whether a cut falls under the rule, ask TRPA before scheduling. TRPA says a forester can be reached at (775) 589-5294, and its page also has an application. The agency decides.

Our two ISA Certified Arborists can describe what a pruning plan would involve and which branches are dead, near a building or in the crown. Ask at the estimate visit. Pruning to the ANSI A300 standard is what we aim for; topping is not pruning. See [tree trimming and pruning](https://battleborntreeservice.com/tree-services/tree-trimming-pruning/) or call [775.232.8243](tel:775.232.8243).

A practical test: if you cannot say whether the branches are in the upper two-thirds, ask before cutting. A photo of the whole tree from the street, with the house in the frame, lets the forester or our arborist answer quickly. Never top a tree to get around the rule.
